Digital Millennium Copyright Act (DMCA) Policy
Welcome to HouzzMedia.com (the “Site”). We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), a copyright owner or their authorized agent may submit a takedown notice to us via our designated DMCA Agent. As an internet service provider, we are entitled to claim immunity from infringement claims under the DMCA’s “safe harbor” provisions. If you believe your copyrighted work has been infringed, please submit a good faith notification as described below.
Notice of Infringement – Claim
To submit a copyright infringement notification, you must provide a written notice that includes the following details:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work that you claim has been infringed.
- Identification of the infringing material that needs to be removed and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page containing the allegedly infringing content).
- Your contact information, including your name, physical address, email address, phone number, and fax number (if applicable).
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, their agent, or the law.
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
Please note that under Title 17 USC §512(f), any person who knowingly and materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney’s fees.
Send all takedown notices to us through our Contact page or email us at dmca@houzzmedia.com for prompt attention.
Counter Notification – Restoration of Material
If you believe that material you posted was mistakenly removed due to a copyright infringement claim, you may submit a counter-notification. This counter-notification must include:
- Your physical or electronic signature.
- A description of the material that was removed and the original location of the material before it was removed.
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
- Your name, address, and telephone number, along with a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the United States, to any judicial district in which we may be found), and that you will accept service of process from the person or company who filed the original infringement claim.
Please send your counter-notice through our Contact page or by email at dmca@houzzmedia.com.
Repeat Infringer Policy
HouzzMedia.com takes copyright infringement seriously. In accordance with the DMCA and other applicable laws, we maintain a list of DMCA notices from copyright holders and make a good faith effort to identify repeat infringers. Accounts of users who are found to be repeat infringers will be terminated in compliance with our internal policy.
